When you use lolili.ca, or send e-mails, text messages, and other communications from any device to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you electronically in a variety of ways, such as by e-mail, text, in-app push notices, or other means of sending messages to you. You agree that all agreements, notices, messages, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

COPYRIGHT

All content included in or made available through lolili.ca such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software--is the property of lolili.ca or its content, suppliers, and is protected by Canadian and international copyright laws. The compilation of all content included in or made available through any Lolili service is the exclusive property of lolili.ca and protected by Canadian and international copyright laws.

PAYMENTS

Payment can be made online through secure credit card payment method, e-transfer by contacting us, or cash in person. Let us know what you prefer. 

SHIPPING

All orders are shipped from Toronto, Canada using CANADA POST, UPS, or FED EX . Note that Lolili does not ship to Post Office boxes (P.O. Box). Once shipped, you will receive a tracking number..

Shipping Costs

For online orders, standard shipping is offered at a flat rate fee as indicated on the invoice.  Occasionally, free shipping will be offered. This applies to standard shipping rates only. Express delivery or specific delivery requests will acquire a charge..  Any applicable customs duties must be paid and cleared by the customer. 

Risk of Loss

Risk of loss and title for items purchased from lolili.ca pass to you upon our delivery to the carrier or, if such items must cross an international border, then risk of loss and title pass to you when they clear customs.

Note: If you refuse a shipment from Lolili, the original shipping charges and the cost of returning the package to Lolili will be deducted from your refund. Your import fees will not be refunded 

RETURNS 

Items must be returned within 10 days of purchase and are accepted for exchange or credit. Lolili must be notified by phone or email before proceeding with the return process. The product must be returned unused, in its original packaging will all tags attached. Return shipping is not the responsibility of Lolili. Sale/clearance items are final.

PRE-ORDERS 

Occasionally, we will promote a new design before we present it to the public.

Items will be shipped as soon as they are in stock

CANCELLING ORDERS

You may cancel or change your order during the shopping and checkout process. Once payment has been accepted your order will be processed and you will receive a confirmation email.  We can only accept a cancellation once payment has been made, if the item has not been shipped.  You will receive your tracking number when the item has been shipped. Please contact us immediately for cancellation if you have not yet received your tracking number.

THE LAWS OF CERTAIN JURISDICTIONS, INCLUDING QUEBEC'S CONSUMER PROTECTION ACT, DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR CONDITIONS OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. LOLILI.CA AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH LOLILI.CA ARE PROVIDED BY LOLILI.CA ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. LOLILI.CA MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE THE INFORMATION, CONTENT, MATERIALS, PRODUCTS OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH LOLILI.CA UNLESS OTHERWISE SPECIFIED IN WRITING. APPLICABLE LAW AND DISPUTES (Not applicable to Quebec consumers)

Any dispute or claim relating in any way to your use of any lolili.ca products or services sold by lolili.ca will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

For Quebec consumers: These Conditions of Use and any dispute of any sort that might arise between you and lolili.ca shall be governed by the laws of the Province of Quebec, without reference to its conflict of law’s provisions, and the laws of Canada applicable therein, and any disputes will be submitted to the courts of competent jurisdiction of the District of Montreal (Quebec).

SITE POLICIES, MODIFICATION, and SEVERABILITY

We reserve the right to make changes to our site, policies, Service Terms, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
